NOTICE OF MORTGAGE FORECLOSURE SALE
Dated: July 31, 2015
THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
YOU ARE NOTIFIED THAT:
1.     Default has occurred in the conditions of the Mortgage dated September 5, 2008, executed by Jesse A. Nordby, Jr. and Jeandrea L. Nordby, as husband and wife, as Mortgagor(s) to North American State Bank, as Mortgagee, and filed for record September 9, 2008, as Document No. 227491, in the Office of the County Recorder of Swift County, Minnesota.  The land described in the Mortgage is not registered land.
2.     The Mortgage has been assigned as follows: None.
3.    The original principal amount secured by the Mortgage was Fifty Seven Thousand Five Hundred and 00/100 Dollars ($57,500.00).
4.    No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
5.    The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.  
6.    At the date of this notice the amount due on the Mortgage, and taxes, if any paid by the holder of the Mortgage is Fifty Seven Thousand Six Hundred Three and 18/100 Dollars ($57,603.18).
7.    As Minn. Stat. § 580.045 requires this Notice to state, Jeandrea L. Nordby, one of the Mortgagors, has been released from financial obligation on the Mortgage by an Order for Judgment and Decree dated July 25, 2012 in Court File No. 34-FA-12-199.
8.    Pursuant to the power of sale in the Mortgage, the Mortgage will be foreclosed, and the land described as follows:
    Lots Seven (7), Eight (8), and the East Nine (E 9’) of Lot Nine (9), Block Twenty-eight (28), Original Townsite, City of Benson, Swift County, Minnesota.
    Physical Address: 1316 Atlantic Avenue, Benson, MN 56215
                           and 1314 Atlantic Avenue, Benson, MN 56215.
Parcel ID Numbers: 23-0171-000 and 23-0170-000
    will be sold by the County Sheriff of Swift County, Minnesota, at public auction on September 24, 2015, at 10:00 a.m. at the Swift County Sheriff’s Office at 301 14th Street N., Suite 4, Benson, MN 56215.
9.    The time allowed by law for redemption by Mortgagor(s) or Mortgagor’s personal representatives or assigns is six (6) months after the date of sale.    
10.    If this is an owner occupied single-family dwelling, the premises must be vacated by March 24, 2016 at 11:59 p.m.
11.    THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
12.    THIS COMMUNICATION IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT, ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
